Acceptable Use Policy

This policy defines permitted and prohibited use of Pavel Buchta's ("we", "us", "Noketa") transactional email platform and services. It forms part of your agreement with us and is critical for email infrastructure compliance and protection of our users and upstream providers.

Permitted use

You may use Noketa to create, send, and manage transactional and marketing emails in compliance with all applicable laws and our Terms of Service.

You are responsible for ensuring that your use of the service, including the content of your emails and the way you collect and use recipient data, complies with the laws of every jurisdiction where your recipients are located (including, where applicable, the EU General Data Protection Regulation (GDPR), the ePrivacy rules, the US CAN-SPAM Act, the Canadian CASL, and other anti-spam or data-protection laws).

Prohibited content and behaviour

You may not use Noketa to send, or to facilitate sending of: (1) spam or unsolicited bulk email; (2) phishing, malware, viruses, or any harmful or deceptive content; (3) content that is illegal, harassing, defamatory, obscene, or that incites violence or violates the rights of others; (4) content that misleads recipients as to the sender's identity (e.g. spoofed or forged headers, misleading "From" or "Reply-To" information).

You may not use purchased, rented, scraped, or third-party mailing lists. Sending to contact lists that were not built with clear, explicit, and provable consent from each recipient is prohibited. You must be able to demonstrate, on request, how and when consent was obtained (e.g. through a confirmed opt-in process).

You may not use the service to abuse infrastructure, circumvent security or rate limits, or use the platform in a way that harms other users, the service, or our reputation with upstream providers (e.g. email deliverability networks).

Email compliance (your responsibility)

CAN-SPAM, GDPR, and other email and data-protection compliance obligations are the sender's responsibility. You must obtain any required consent from recipients before sending marketing or non-transactional emails, include a clear and easy-to-find unsubscribe mechanism in marketing emails, and honour opt-out requests without delay.

You must accurately identify the sender in each message (e.g. "From" and "Reply-To" must be clear and not misleading). If you send on behalf of another organisation, that must be clearly stated.

Enforcement

We may suspend or terminate your access to the service, without prior notice, if we reasonably believe you have violated this Acceptable Use Policy. We may also intercept or block traffic that we believe is being used unlawfully or in breach of this policy.

We may report illegal activity to the relevant authorities and cooperate with lawful requests from law enforcement or regulators. No refund or credit is owed for any suspension or termination resulting from an AUP violation.

The consequences of violation, including termination and liability, are set out in our Terms of Service. By using Noketa you agree to this policy; repeated or serious violations may result in permanent termination of your account.
